Terms of Service

Welcome to HowWasThat (referred to as "Platform", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the HowWasThat platform, including our website howwasthat.in, and related services. By registering, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

  • Platform: The HowWasThat website, mobile app, and all associated services.
  • Business: A registered entity or individual using the Platform to create review campaigns.
  • Reviewer: An individual registered on the Platform to complete review tasks and earn rewards.
  • Campaign: A structured review task created by a Business for Reviewers to complete.
  • Reward / Payout: Compensation paid to Reviewers upon successful campaign completion.
  • Wallet: The in-platform digital wallet used to manage funds.
  • Content: Any text, images, reviews, feedback, or other material submitted on the Platform.

2. Eligibility

  • You must be at least 18 years of age.
  • You must have a valid Indian bank account or UPI ID for payouts (Reviewers).
  • Businesses must be legally registered entities or individuals operating within India.
  • By using the Platform, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not create more than one account per role (Business or Reviewer).
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Services

HowWasThat provides a marketplace where Businesses can create review campaigns for their products, services, or experiences, and Reviewers can browse, accept, and complete campaigns to earn rewards. We facilitate payments, verification, and dispute resolution.

We are an intermediary platform and do not guarantee specific review outcomes or the quality of any experience offered by a Business.

5. Business Responsibilities

  • Businesses must provide accurate campaign descriptions, instructions, and reward amounts.
  • Campaign content must comply with applicable laws and platform policies.
  • Businesses must not use the Platform to manipulate reviews in a fraudulent or deceptive manner.
  • Businesses are solely responsible for the experiences, products, or services offered.

6. Reviewer Responsibilities

  • Reviewers must genuinely visit or experience the Business's offering before submitting a review.
  • Reviews must be honest, original, and based on actual experience.
  • Reviewers must not submit fake, fabricated, or copy-pasted reviews.
  • Reviewers must not misrepresent their identity or experience.

7. Payments and Rewards

  • Businesses fund their campaigns by depositing into their Platform Wallet.
  • Reviewers earn rewards upon campaign completion and admin approval.
  • Payouts are processed to the Reviewer's linked bank account or UPI ID.
  • Platform commission is deducted as per the current pricing structure.
  • All transactions are in Indian Rupees (INR).

8. Content Ownership and Licence

  • You retain ownership of any content you submit.
  • By submitting content, you grant HowWasThat a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute your content for platform operations.
  • We reserve the right to remove any content that violates these Terms or applicable law.

9. Prohibited Activities

You must not:

  • Create fake accounts or impersonate others.
  • Submit fraudulent reviews or manipulate campaign outcomes.
  • Use bots, scripts, or automated tools on the Platform.
  • Harass, threaten, or abuse other users.
  • Violate any applicable laws, including consumer protection and advertising standards.

10. Verification and Fraud Detection

  • We use manual and automated systems to verify review authenticity.
  • Suspicious activity may result in account suspension or reward forfeiture.
  • We reserve the right to request supporting proof (e.g., receipts, photos) for verification.

11. Intellectual Property

All Platform content, trademarks, logos, and software are owned by HowWasThat or its licensors. You may not copy, reproduce, or distribute any Platform content without written permission.

12. Limitation of Liability

To the maximum extent permitted by law, HowWasThat shall not be liable for indirect, incidental, or consequential damages; loss of earnings, data, or business opportunities; or actions or omissions of Businesses or Reviewers on the Platform.

13. Indemnification

You agree to indemnify and hold harmless HowWasThat, its directors, employees, and affiliates from any claims, damages, or liabilities arising from your use of the Platform or violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our discretion with or without notice.

15. Modifications to Terms

We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.

17. Dispute Resolution

We encourage users to resolve disputes amicably. If unresolved, disputes may be escalated through our Grievance Redressal process.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, along with our Privacy Policy and other platform policies, constitute the entire agreement between you and HowWasThat.
